1. Preamble
is operating an online traveling portal. The following general business conditions (GBC) are to direct the contract relation between clients, as the agent and service providers (operators, airlines, hotels, car rentals) as well as service assistants, (see Nr 4 hereunder), in addition to the relevant terms and conditions of § 651a ff of the German Civil Code. specifically points out to all clients and traveling partners that traveling contracts are not agreed with , but with the service provider quoted on the flight ticket or travel documentation, and their general business conditions (GBC) apply. agrees to procurement instructions. Therefore the terms and conditions below pertain solely to the procurement activities and have no influence upon the conditions governing the traveling arrangements thus procured.

2. Subject matter of agreement
A binding booking instruction is agreed, as soon as the client clicks on the "booking" button in the template / screen. This is a legally binding instruction for to organize traveling or other tourism-related service arrangements for the client with a specific service provider. The supply of the booked services as such is not part of the obligations of Lufthansa City Centre. The client simultaneously declares himself contractually capable and of age when entering this legally binding instruction, in terms of §§ 104 ff of the German Civil Code. The client is legally bound by this agreement for 72 hours. will accept these instructions or contact the client within this period. 's subsequently submitted invoice is strictly held as efficient proof of its legally binding acceptance of the instructions by the client. When paying by credit card, acceptance is indicated as soon as the client's / partner's / traveler's account is debited or a deposit is paid. Procurement is considered to have taken place, as soon as the traveling documents have been posted to the client.
You are informed that we are not saving the contents of the agreement. You will receive a summary of your choice of traveling services and the relevant costs thereof together with our booking confirmation by e-mail.

3. Obligations
OBLIGATIONS OF LUFTHANSA CITY CENTRE
The contractual obligation of is the proper procurement of the transport or individual tourism service as booked. The due performance of the booked service as such is not part of the obligations of the . Lufthansa City Centre acts upon instruction and for the account of the respective service provider. The tariff, carriage and participation conditions of the respective service providers are applicable to the agency contracts agreed via .
Further information regarding the traveling services and conditions indicated on this website are available on the websites of the respective service providers and their GBC's (see booking procedures).
According to Ordinance (EC) No. 2111/2005 of the European Parliament and the Council, dated 14.12.2005, LCC24 informs the client about the identity of the airline actually providing the service on the booking pages via the Info-button, as well as explicitly and obviously on the confirmation sheet of the flight booking.
OBLIGATIONS OF THE CLIENT
a) Each booking undertaken by a client via the website of a , constitutes an offer for an agreement with the respective service provider with regard to the services chosen by the client.
b) The client is obliged to check all booking confirmation/s, invoices and/or travel documents immediately upon receipt as to their accuracy and to advise within two days of any discrepancies or deviations. Belated notice/s of mistakes or discrepancies specifically do not entitle the client to cancellation of the agreement.
c) Kindly inform us immediately if you, as the client or tour participant, have not received your traveling documents by latest five (5) days prior to commencement of the intended journey. Provided that payment has been received, we will in such an event, forward the documents immediately or, against proof of payment, deliver them at the departure airport one day prior to departure, at the earliest. Should you fail to notify us and be unable to commence your journey due to missing documents, we are obliged to treat such a case as cancellation and hold you liable for costs. For flight tickets, recommends its clients the use of e-tickets (electronic tickets) as no liability is accepted for delivery of flight tickets by mail, and the client is liable for costs of any replacement/s required.

4. - Fulfillment Center (Service Assistance)
employs the following performance assistance in the procurement of the services chosen by the client (flights, tours, rental cars, city and wellness tours etc):
FLIGHT TICKETS:
Deukom Travel with office in Cape Town issues airlines tickets which are booked through the South African Booking Engine.
Flightone Travelservice Ltd with registered offices in Berlin is officially instructed as service provider for all services concerning flight tickets in the scope of on- and off-line bookings, alterations, cancellations, information, accounting, further assistance and conclusion of all all-inclusive and last-minute programmes.
The only exception to the agreement between , Flightone and the client are bookings with low-cost airlines, where Flightone only arranges for receipt of the service fees. Any services relating to bookings completed with low-cost airlines is the sole responsibility of the airline concerned.
lastminute.com AB with registered address in London (UK) and branch in Munich, is instructed as service provider for handling the following traveling activities: city tours, wellness tours, skiing tours and hotels all over the world.
holidayautos GmbH is situated in Munich and Johannesburg and is assigned to handle all car rentals.

5. Liability by as agents
a) employs reasonable efforts to ensure that the information published on this website is correct. does not guarantee that this information is accurate. Information, software and services published / provided on this website may contain inaccuracies or spelling mistakes. Information stored is subject to regular amendments.
b) Any liability by or its service providers on this website is limited to intent by gross negligence.
c) Data relating to carriage or procured tourism services are based exclusively on the data of the respective service providers. They do not constitute any warranties by towards the client / traveler.
d) is only liable for the proper procurement of the services within the scope of due diligence obligations of a decent merchant, but not for the completeness, correctness or accuracy of data, nor the provision of such booked services by the service provider.

6. Variations in services
a) Amendments and variations of specific travel services from the agreed undertaking are only permissible, should they become necessary after conclusion of the contract, if they are not caused by the service provider against the principles of good faith, and incidentally do not compromise the general travel program.
b) Flying times, traffic routes, aircraft and airlines employed are expressly subject to change without prior notice.

7. Reservation change/s or cancellation/s
a) The possibility to effect changes in reservation/s, cancellation/s or transfer to another person, as well as the relevant terms and conditions thereof and costs pertaining thereto are exclusively subject to the travel agreements and GBCs of the relevant service providers, as the case may be, and cannot be influenced by .
b) A fee of EUR 20,00 per ticket arises from the processing of change/s in reservation/s and cancellation/s in addition to any cancellation tariffs currently applicable. Bookings with low-cost airlines have to be amended or cancelled directly with the airline.
Applicable fees are determined by the low-cost airline.
c) Concerning amendment and cancellation fees, only the agreed contract between the relevant service provider and the client is significant.
d) Kindly obtain any information regarding booking amendments and cancellation/s of your reservation/s from our Fulfillment Center (see 4 above).
recommends that its client/s obtain a separate travel cancellation insurance in this regard, as travel options offered do not include such insurance.

8. Acts of God (force major)
is not liable for the consequences of Acts of God (force major) within the scope of this agreement. These include orders by authorities, wars, domestic riots, aircraft hijacking, terrorist attacks, fire, floods, power failures, accidents, storms, strikes, lock-outs or other labour dispute actions, which may affect the services of or their service providers.
To enable clients to obtain information at all times with respect to their travel arrangements (flight, all-inclusive tours etc) the employees of our Call Center in our Fulfillment Center are at their disposal (see 4 above).

9. Withdrawal/Cancellation by or its service provider
and its service providers reserve the right to refuse specific booking or procurement instructions without divulging reasons, specifically in the event of
- the client being unworthy of credit
- payment not being reliably secured when client/s present credit card/s
- it transpiring that client is not contractually capable and/or of age according to the provisions of §§ 104 ff of the German Civil Code

10. Variations in price and/or services
a) Due to circumstances not controllable by , prices and services within the conditions of service providers might be subject to change, which entitle in turn to amendments. These include specifically fluctuations in foreign currency and exchange rates, transport fees and rates (e.g. fuel surcharges), taxes and fees charged by authorities, respectively e.g. airport security and landing fees.
b) The terms and conditions of variations in price and service structures can be referred to in the GBCs of the relevant service providers. Should be notified of such variations, it will forward them to client/s without delay.

11. Service charges
Since most airlines do not pay sales commission anymore, imposes service charges, as do all other distribution channels. These amount to 19 Euro within Germany, 25 Euro within Europe and 35 Euro for inter-continental flights; they are included in the lump sum price, but are settled separately from the transport service.
In case of low-cost airlines the charge amounts to 20 Euro and is displayed separately at the end of the reservation.

12. Passport, visa, customs and health regulations
All travellers are solely responsible, in principle, to ensure that all requirements are fulfilled by them to enable them to conduct the arranged travels, and that all legal requirements have been observed, specifically regulations pertaining to domestic and international departure and entry, health, passport and visa. The same applies to obtaining the required travel documentation.

13. Prohibition of cession or transfer
The traveler may not cede, transfer or assign any claims or rights to third parties (including marriage partners or family) that he may have with regard to . Legal assertion of assigned rights is ruled out.

14. Jurisdiction
German law is applicable. For business people, persons not being subject to general jurisdiction within Germany, as well as persons who move overseas after conclusion of this agreement, or who normally live overseas, or whose usual residence is unknown when legal action is instituted - Munich is held to have jurisdiction. The general business terms and conditions comply with the status quo on 01.01.2007.

15. Variations of General Business Conditions
reserves the right to alter, amend and renew the General Business Conditions for utilization of this website at any time with regard to future impact, without being obliged to notify the user. The current version of the relevant General Business Conditions will be displayed on the website whenever they become valid. The user declares his agreement to the amended General Business Conditions with his continued utilization of the website after the implementation of such amendments.

16. Safeguarding Clause
Should one of the previous conditions be or become invalid, then this invalidity does not affect the other conditions, which retain their validity. The validity of the travel contract as such also remains valid.
